1. Agreement to Terms

By downloading, installing, or using Heyfox Running ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

Heyfox Running is an AI-powered running coach application for Apple Watch and iPhone. The App provides:

  • Personalized training plans based on your fitness data
  • Real-time coaching during runs
  • Analysis of running metrics from Apple Watch sensors
  • Recovery recommendations based on health data
  • Race time predictions
  • AI-powered coaching conversations

3. Medical Disclaimer

IMPORTANT: Heyfox Running is NOT a medical device and does NOT provide medical advice.

  • The App is for informational and fitness purposes only
  • Training recommendations are based on algorithms, not medical expertise
  • Always consult a physician before starting any exercise program
  • Stop exercising immediately if you feel pain, dizziness, or discomfort
  • Do not rely on the App to diagnose, treat, or prevent any medical condition
  • Heart rate, HRV, and other metrics are estimates and may not be accurate

If you have any health concerns or pre-existing medical conditions, consult your doctor before using this App or following its recommendations.

4. Eligibility

  • You must be at least 13 years old to use the App
  • If you are under 18, you must have parental consent
  • You must have a compatible Apple Watch and iPhone
  • You must provide accurate information when creating an account

5. User Account

  • You are responsible for maintaining the security of your account
  • You must not share your account credentials with others
  • You must notify us immediately of any unauthorized access
  • We may suspend or terminate accounts that violate these terms

6. Subscription and Payments

Free Trial

  • New users may be eligible for a free trial period
  • The trial provides full access to premium features
  • After the trial, a paid subscription is required for continued access

Subscription

  • Subscriptions are billed through Apple App Store
  • Prices are displayed in your local currency
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
  • You can manage subscriptions in your Apple ID settings

Refunds

  • Refunds are handled by Apple according to their refund policy
  • We do not process refunds directly
  • Contact Apple Support for refund requests

7. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Attempt to reverse engineer, decompile, or hack the App
  • Circumvent any security measures or access restrictions
  • Use the App to collect data about other users
  • Interfere with the App's servers or infrastructure
  • Share or resell your subscription access
  • Use automated systems (bots) to interact with the App
  • Upload malicious content or code

8. Intellectual Property

  • The App, its content, features, and functionality are owned by Heyfox
  • The App is protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, or create derivative works without permission
  • "Heyfox" and the Heyfox logo are trademarks of Heyfox
  • Your workout data remains your property

9. Third-Party Services

The App may integrate with third-party services:

  • Apple HealthKit: For accessing your health and fitness data
  • Apple Watch: For real-time workout tracking
  • Optional exports: To services like Strava (if you choose)

These services have their own terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • We do not guarantee the App will be error-free or uninterrupted
  • We do not guarantee the accuracy of AI recommendations
  • We do not guarantee specific fitness or performance results
  • Sensor data from Apple Watch may not always be accurate

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYFOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or health issues arising from following app recommendations
  • Loss of data or workout history
  • Missed training or race performance
  • Any damages exceeding the amount you paid for the App in the past 12 months

12. Indemnification

You agree to indemnify and hold harmless Heyfox, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Termination

  • You may stop using the App at any time
  • You may delete your account from the app settings
  • We may suspend or terminate your access for violations of these Terms
  • Upon termination, your right to use the App ceases immediately
  • Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of France, unless prohibited by local consumer protection laws.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
